Mediation
A mediator functions as a neutral third party who helps the two sides in a dispute find solutions that work for them. Unlike arbitrators, mediators do not have the authority to make decisions. A mediator's role is limited to helping the parties work toward an agreement that they create.
Mediation is much more flexible than litigation and the atmosphere is more relaxed. Most people find they are able to communicate more effectively with each other in this setting. Under the supervision of a professional mediator, the parties and their lawyers will discuss possible means for resolving the dispute. Successful mediation can solve disputes without the time and expense of taking a case to trial.

Arbitration
Arbitration is a different process. In arbitration, each party tells his or her side of the story and agrees to let an arbitrator decide the outcome. The arbitrator's role is similar to that of a judge, reviewing evidence and hearing statements from each party. The attorneys for each party then present a summary of the evidence to the arbitrator. After reviewing the evidence, the arbitrator makes a legally binding decision.
