Workplace Retaliation Claims

Workplace retaliation claims involve allegations that an employer has illegally retaliated against the employee for something he or she has legally done, such as:

  • Claiming workers' compensation benefits
  • Supporting a claim of discrimination or participating in a discriminatory complaint
  • Demanding reasonable accommodations for a disability
  • Whistleblowing or informing the authorities about illegal activities happening in the workplace

In these claims, usually the employer is being accused of limiting advancement, withholding pay, or wrongfully terminating the employee in direct retaliation for these actions. Generally, the existence of other permissible reasons for the employer's actions, such as poor work performance, tardiness, etc. weakens the employee's case tremendously.
