Unemployment Law in Utah
You may be eligible for unemployment benefits if you meet the following criteria:
- You worked sufficient hours in the previous four quarters
- You earned sufficient wages during that time
- You are unemployed by no fault of your own
- You are available for and actively seeking full-time employment
If you quit or were fired, the Department of Workforce Services (DWS) will review your claim and determine whether you qualify for unemployment. Utah is an employment at-will state, but your employer must show just cause to fire you. If you were unlawfully denied unemployment, our firm can represent you in the appeals process.
We also represent employers who are being investigated by the DWS. Our firm can defend your business against audits for issues such as unemployment compensation denials, misclassification of employees or contractors, as well as other violations of the Fair Labor Standards Act (FLSA). In addition, if a former employee is suing your company for unemployment benefits, we can assist you.
