How Is Alimony Determined?

The financial circumstances of each person are carefully considered when determining alimony. The court reviews several economic and noneconomic factors, including:

  • Length of the marriage
  • Income and earning capacities of each person
  • Monthly debts and obligations of each person, as well as the ability to pay them
  • Ability of the payor to provide financial support
  • Marital fault
  • Standard of living at the time of separation
  • Whether one person supported the education or training of the other
  • Whether the recipient has custody of minor children in need of support

The court can modify spousal support orders if one party's financial circumstances undergo a substantial change. If the party receiving alimony remarries or lives with a financially supportive member of the opposite sex, alimony will be terminated.
